You can make personal injury claims in Ireland if you have been physically injured in an accident and someone else was at least partially to blame for the accident. Personal Injury Claims Procedure in Ireland

On the face of it, the procedure for making a personal injury claims in Ireland is really very straightforward. You must simply submit an application form, a medical assessment form and a payment of €50.

On receipt of the claim, the Injuries Board of Ireland sends a Formal Notice of the Claim to the person against whom you wish the claim to be made. This person is called the Respondent. Should the Respondent accept the assessment, the Injury Board then proceeds to examine the medical assessment form and any details related to out of pocket expenses, property damage or loss or earnings given by the Claimant.

Once a decision has been made the Claimant and Respondent are notified and can both either accept the level of damages or either one can reject it.  Should either party refuse to accept the assessment, then the case will proceed to court.

The Injuries Board claims procedure is document driven. You will never need to make a statement or attend a hearing. The Injuries Board receives your application and assesses damages based on the medical report and any additional details related to out of pocket expenses or suffering.

In some very straightforward cases this impersonal approach works well. With no need to participate beyond the initial application, the Claimant can simply let the Injuries Board go through the whole process and in the end trust that what they are offered is a fair settlement for the injuries they sustained. And there is the rub, for personal injury litigation is rarely that clear cut!!

When a person has sustained injury, there may be a need to gather more evidence in support of out-of- pocket expenses or for a more detailed medical examination.  The average man in the street is not aware of the complexity of a personal injury assessment and how both evidence and the presentation of it can help his case.

Similarly most people have no idea what level of assessment to expect for a specific injury. Should a Claimant accept an assessment of €5,000 for a broken toe? How about €15,000 for a fractured elbow?  Every  case is different of course, and the Claimant’s level of fault (if any) must be taken into account but generally speaking, if a Claimant settled for either of those figures he would likely have walked away with a good deal less than he was due.

Engaging a solicitor is not a guarantee of receiving a higher settlement but it is a way of ensuring that the application includes all the documentation necessary to secure a fair award. Those who have a solicitor guiding them through the personal injury claims process are also much less likely to walk away with a lower award than their pain and suffering merits and lastly with a solicitor already on-board, should the Respondent refuse the assessment and force the case to court, the Claimant already has professionally prepared evidentiary documents in hand.

One last thing to note is that whether the Respondent is an individual, a restaurant, small business owner, the local authority or your employer, your real obstacle to receiving a fair and full settlement is the insurance company lawyer who is battling against your case.
